Road Sense Australia delivers an accredited community-based Traffic Offender Intervention Program (TOIP) designed to help participants understand road safety and become safer drivers.

What is the Traffic Offender Intervention Program?

A TOIP targets safe road use and responsible driving conduct. It is designed for driver offenders who have exceeded their demerit points limit, in line with newer road legislation introduced 1 February 2015.

The newer legislation penalises driver offenders who continually demonstrate risky driving behaviours and put other road users at risk of danger. The legislation offers driver offenders a chance to gain a better understanding of road rules, understand the consequences of risky driving; and attempts to motivate positive driving behaviour change.

Unrestricted licence drivers who surpass their demerit points 2 times in a 5 year period are required to pass their Driver Knowledge Test again and to also complete a TOIP. The Roads and Maritime Services will arrange and refer eligible TOIP candidates to Road Sense Australia and they will be required to complete our TOIP. Our TOIP modules are created to improve driver understanding of the implications of dangerous, risky driving practices and to reduce their chances of re-offending.

Complete an Online TOIP Program

Register and complete our TOIP program online. Once registered, you will receive email access in 1-2 business hours. You will have TOIP program online access for 1 month from the date you access the material. Through our TOIP program online you can save your work and complete it later as many times as necessary. If you require more than 1 month of access to our materials, just let us know and we can grant you an extension!

Once you have completed TOIP, we will consult back to the Court on your behalf (TOIP referral) and we will email your certificate to both the Court and yourself (and your lawyer if you have one).

Unfortunately, the Roads and Maritime Services (RMS) does not accept electronic copies of certificates, so if we are required to report to the RMS on your behalf (TOIP referral), we will post you the certificate if you are completing the TOIP program online.

Frequently Asked Questions

As of 1 February 2015, unrestricted licence holders who exceed their demerit points limit twice in five years must re-sit and pass the Driver Knowledge Test and complete a Driver Education Course.

The Roads and Maritime Services will refer TOIP candidates to Road Sense Australia and they will be required to complete our traffic offender intervention program.

At Road Sense Australia our TOIP program is divided into 10 modules covering a variety of different subjects.

You can choose to do our program in a classroom, online, via Zoom or a combination of these, and you can split it up over multiple weeks, or do it all in one go.

At Road Sense Australia our TOIP program takes about 6 hours to complete, regardless of your choice of delivery option – classroom, via Zoom, online or a combination of these. With online delivery, you can access the program for 1 month from the date that the material is provided, you can also extend your access by contacting us.

Our TOIP program costs $185 to complete. As a not-for-profit, all of our proceeds go back into the community to fund driver education programs for the most vulnerable and the underprivileged.

The TOIP is a driver education program targeting road safety and responsible driving behaviours. The sessions are designed to increase awareness of the consequences of dangerous driving practices and are intended to reduce the likelihood of you re-offending.

Our TOIP combines a cognitive behavioural approach with reality-based learning. It provides you with the information and skills necessary to develop positive attitudes towards driving and to become safer, more responsible road users.

A TOIP provider cannot guarantee you a lesser sentence because you complete their drivers offender course. We highly recommend that you question the credibility of any TOIP provider that tells you that doing their course will get you a lesser sentence.

There are there are many variables that can affect your sentence:

  • Your driving history
  • The circumstances surrounding your offence
  • Your attitude towards the police / law enforcement
  • How you act at Court
  • What you have learnt from your experiences and from completing TOIP
  • Your lawyer

A Magistrate will take these factors and others into consideration at the time of handing down their sentence. It is only the Magistrate that can determine your sentence.

However, there are things that you can do to help your case, and in addition to completing TOIP, having a great lawyer is a good place to start. You need to be open and honest with them about everything and they will try to use the law to your advantage. A ‘Court Report’ is a detailed account of the participants progress through the program. The report can be created at any of the following progress points:

  • the participant successfully completes TOIP; or 
  • Road Sense determines that the participant failed to complete the program (including expulsion); or  
  • at any time the participant requests the report. 

The Court Report is emailed to the Court nominated (by the participant) on the TOIP Registration Form. The participant (and any legal representative nominated by the participant) will also receive a copy. 

If a participant has been referred to TOIP by the NSW Roads and Maritime Services (RMS), digital certificates cannot be issued. Instead, a hard copy of the ITOP Certificate of Completion will be posted to the participant’s nominated mailing address. The participant should then present this to a Service NSW Centre.
